These terms cover how we work together, what we provide, what you agree to, and how we handle the details. We've tried to keep it readable. Please take a few minutes to scroll through before you continue.

By submitting your information and clicking NEXT, you're letting us know you've reviewed these terms and agree to them.

Who we are

We're Legacy Alarm, a California home security company and an authorized dealer of Brinks Home, one of the largest professional alarm monitoring providers in the country. We sell residential security systems, coordinate setup remotely, and support our customers through their first year and beyond.

Legacy Alarm is a brand of Brijon Holdings LLC. We operate under California Alarm Company Operator License No. 8159, regulated by the Bureau of Security and Investigative Services. You can reach us at support@legacyalarm.com or (855) 532-0325. Our mailing address is PO Box 82, Rocklin, CA 95677.

A few words you'll see in here

To keep things clear:

Your System is the alarm panel, sensors, and equipment we ship to you. Your Premises is the home address where it's installed. Monitoring means the 24/7 service Brinks Home provides on the back end. Your Activation Date is the day your System successfully connects to monitoring after your setup call.

We offer two paths. The term plan, which you'll choose as either a 36 month or a 60 month monitoring commitment, comes with your base equipment included at no upfront cost. The month-to-month plan lets you buy your equipment upfront with no term commitment. Wherever a section only applies to one path, we say so directly.

You make these choices at checkout, not on this page. The specific plan length, monthly rate, payment method, and equipment you select on the cart page, and confirm at the payment step, are the terms that govern your account.

For term plan customers, your first 12 months are called Stage 1, when Legacy Alarm is your primary point of contact. From month 13 forward (Stage 2), Brinks Home takes over your account.

Who can sign up

You need to be at least 18 years old, have authority to install a security system at the Premises, and have a working internet connection there. If you rent your home, you'll need permission from your landlord or property manager, and you take responsibility for any third-party claims arising from your installation or use.

Choosing your plan

At checkout you'll pick one of two paths:

The 36 or 60 month plan gets you a Qolsys IQ5 panel and base sensors at no upfront equipment cost. In exchange, you commit to either 36 or 60 months of monitoring through Brinks Home. You choose the term length yourself on the cart page, and the 60 month plan comes at a lower monthly rate than the 36 month plan. Monitoring is billed monthly, and ACH bank draft costs $2 per month less than credit or debit card.

The month-to-month plan lets you buy your equipment outright and pay monthly with no term commitment. Monitoring is billed monthly at the same ACH and card difference of $2 per month. You can cancel any time with 30 days notice. Legacy Alarm manages your account directly for as long as you're a customer.

You'll see your exact rate, your equipment, and every charge in real time on the cart page as you make your selections, and again on the payment summary before you pay.

How the 36 or 60 month plan works

If you choose this path, your base equipment is included at no upfront cost in exchange for your monitoring commitment. You choose 36 or 60 months on the cart page, and selecting 60 months lowers your monthly rate.

You can add equipment if you want to, but you don't have to. For anything you add, you choose how to pay for it. You can pay a one-time upfront cost, or you can increase your monthly monitoring so that we cover the equipment cost over your term. You can mix and match, choosing upfront payment for some items and a monthly increase for others. Every choice updates your totals on the cart page in real time, so the rate and charges you confirm are the rate and charges you see.

We collect your first month's monitoring and any one-time upfront charges you selected when you check out. Starting in month 2, Brinks Home bills you directly each month for the rest of your term.

Your term begins on your Activation Date. After the initial term ends, your plan auto-renews month-to-month unless you give 30 days written notice to cancel. Your rate is locked for the first 12 months. After month 12, Brinks Home may adjust the rate no more than once a year by no more than the greater of 5% or the Consumer Price Index change, with advance written notice.

During Stage 1, your first year, Legacy Alarm is your dedicated point of contact for support, service, and account questions. You can also reach Brinks Home support directly anytime. At month 13, you transition to Stage 2, where Brinks Home assumes full account responsibility. From that point on, Brinks Home offers technician service visits at $75 per trip during regular business hours, in case you ever want hands-on help.

Your equipment stays our property until your 36 or 60 month term is complete, at which point it becomes yours at no additional charge.

How the month-to-month plan works

If you choose this path, you buy your equipment outright at checkout, and it's yours from that moment. You pay monitoring monthly with no term commitment. You can cancel any time with 30 days written notice, and we can adjust rates during any renewal period with at least 30 days notice to your email on file.

Legacy Alarm is your point of contact for everything throughout the life of your account. Brinks Home provides monitoring on the back end, but you'll always reach out to us first.

Equipment and shipping

We pre-program your System before it ships so setup is fast. Equipment goes out via tracked carrier to your Premises address. Once delivery is confirmed, the equipment is in your hands and risk of loss transfers to you.

Setting up your system

When your System arrives, a Legacy Alarm security advisor walks you through a remote setup call to connect your equipment to monitoring. This is required to activate your service. We'll reach out to schedule the call once delivery is confirmed, usually the same day.

The 14-day activation window (36 or 60 month plan)

If you're on the 36 or 60 month plan, you have 14 days from confirmed delivery to complete your setup call and activate your System. If you don't activate within that window and haven't paid for the equipment upfront, the equipment's retail value, which is itemized and shown to you at checkout, becomes due, and you authorize us to charge the payment method on file for that amount.

This isn't a penalty. It just reflects the actual value of the equipment we sent you. If you need more time, just reach out before the window closes. We're flexible when you communicate with us.

If your system can't be activated

We offer a 30-day compatibility guarantee. If after working with our support team in good faith your System can't be activated due to genuine compatibility issues or a manufacturer defect, you can return it within 30 days of confirmed delivery with no penalty.

A few conditions:

You'll need to have completed at least one setup call with us and made a reasonable effort to troubleshoot first. All components originally shipped need to come back. Anything missing gets charged at individual retail cost. Components need to come back in the same working condition, and we reserve the right to charge for damage beyond normal handling. Pack things securely so they survive shipping, and we'll send you a prepaid return label once your return is approved. Ship returns to: Legacy Alarm Returns, PO Box 82, Rocklin, CA 95677.

Once we receive and inspect everything, we void your plan, refund what you paid, and cancel the Brinks Home agreement on your behalf, with no early termination fee. Refunds go back to your original payment method within 10 business days.

This is for genuine compatibility or defect issues. It doesn't cover change of mind or buyer's remorse.

Updates to your system over time

Your System receives automatic firmware and software updates from Brinks Home and Alarm.com over the course of your service. Features may be added, changed, or removed as the platform evolves. If an automatic update fails for some reason, you can run it manually from your keypad, mobile app, or web portal. We're not liable for changes in features that result from these routine updates.

Adding equipment after you're set up

If you're on the month-to-month plan, you're free to add sensors, Z-Wave devices, or compatible equipment to your System later on. Just make sure anything you add is paired correctly and doesn't interfere with monitoring. Unauthorized modifications void your warranty and may impact monitoring, and we and Brinks Home aren't responsible for issues caused by customer-added equipment.

If you're on the 36 or 60 month plan, reach out to us before adding equipment so we can coordinate proper pairing and make sure your monitoring isn't affected. Same warranty rules apply.

Moving or transferring your account

If you move, let us know before relocating. Your System can move with you. For 36 or 60 month plan customers in Stage 1, we'll coordinate with Brinks Home to update your monitored address. For month-to-month customers, we'll update your account directly so monitoring and emergency response go to the right place.

If you sell your home and the buyer wants to take over your 36 or 60 month plan, that's transferable subject to a Brinks Home approval process, usually a soft credit check and electronic signature from the new owner. No transfer penalty. Month-to-month accounts transfer freely between owners. Just let us know the new account holder's information so we can update everything.

Your first payment

By proceeding with your order, you authorize us to charge your payment method at checkout for your first month's monitoring plus any one-time upfront charges you selected on the cart page. The full breakdown of what's due today is shown on your payment summary before you pay.

Ongoing billing

If you're on the 36 or 60 month plan, Brinks Home bills you directly each month beginning in month 2, using the payment method you authorize in the Brinks Home Monitoring Agreement. You authorize us to share your billing information with Brinks Home so they can set this up.

If you're on the month-to-month plan, Legacy Alarm bills you directly each month using the payment method on file. Your authorization stays in effect until you cancel.

ACH vs. card

You choose your monthly payment method at checkout, and ACH bank draft costs $2 per month less than credit or debit card. The difference covers card processing costs, and we pass the ACH savings back to you. ACH is selected by default, but the choice is yours, and you can switch later. Whatever you choose governs your account, and your rate adjusts to match the method you're using.

The exact monthly rate depends on the path your home qualifies for and the options you select at checkout. The rate you confirm at the payment step is the rate that governs your account and the rate reflected on your Brinks Home agreement.

Rate changes over time

If you're on the 36 or 60 month plan, your rate is locked for the first 12 months. After that, Brinks Home may adjust no more than once per year by no more than the greater of 5% or the Consumer Price Index change, with advance written notice.

If you're on the month-to-month plan, we may adjust rates during any renewal period with at least 30 days written notice to your email on file.

If a payment fails

If a payment is declined, we'll let you know by email and may try the payment again. Accounts with unpaid balances may be suspended. We can charge a failed payment fee up to the maximum permitted by California law.

Your overall payment authorization

By proceeding, you authorize us to charge your payment method for: your first month's monitoring, any one-time upfront charges you selected at checkout, the equipment's retail value as shown at checkout if you don't activate within the 14-day window (36 or 60 month plan), the cost of missing or damaged components if a return doesn't meet our conditions, and any other charges spelled out in these terms.

Why there's a separate Brinks Home agreement (36 or 60 month plan)

If you select a 36 or 60 month plan, your monitoring is provided under a separate Brinks Home Alarm Monitoring Agreement. As an authorized Brinks Home dealer, we act as your agent to prepare and execute that agreement on your behalf, reflecting the plan length, monitoring rate, payment method, and equipment you select at checkout. By choosing a 36 or 60 month plan and completing your order, you authorize us to execute that agreement on your behalf based on those selections, and you confirm the material terms summarized just below.

We execute the Brinks Home agreement only after you've completed your purchase. Once your account is finalized, we'll email you a fully executed copy of the agreement for your records.

What's in the Brinks Home agreement (36 or 60 month plan)

Here's what you're signing up for when you choose a 36 or 60 month plan:

Monitoring provider: BH Security, LLC dba Brinks Home, P.O. Box 814530, Dallas, TX 75381.

Initial term: 36 or 60 months from your Activation Date, depending on the plan length you select at checkout, then auto-renewing month-to-month.

Monthly rate: the monitoring rate you select and confirm at checkout. ACH bank draft is $2 per month less than card, and the 60 month plan rate is lower than the 36 month plan rate. Billed directly by Brinks Home starting in month 2.

Rate changes: Fixed for the first 12 months. After month 12, up to the greater of 5% or CPI annually, with advance notice.

Early cancellation fee: If you cancel during your initial 36 or 60 month term, you owe 80% of the remaining monthly payments. This isn't a penalty. It's how Brinks Home recovers the cost of providing you free equipment and service.

Liability cap: Brinks Home's liability for any claim is limited to $1,000. Brinks Home is not an insurer.

Dispute resolution: Disputes go through binding arbitration. Class action and jury trial rights are waived. Punitive damages are waived.

Right to cancel: You can cancel without penalty within 3 business days of execution, or 5 business days if you're 65 or older. See the cancellation section below.

Stage 2 transition: At month 13, Brinks Home takes over full account responsibility.

Service visits: During Stage 2, Brinks Home offers technician service visits at $75 per trip during regular business hours.

Disclaimer: Brinks Home doesn't warrant that your System or monitoring will prevent any loss by burglary, fire, robbery, or otherwise.

Who you call when you need help (36 or 60 month plan)

During Stage 1, your first 12 months, Legacy Alarm is your dedicated support team. We coordinate setup, handle questions, and resolve issues. You can also reach Brinks Home support directly anytime. Sometimes they'll handle the issue and sometimes they'll route you back to us depending on the situation.

At month 13, you transition to Stage 2, and Brinks Home becomes your primary support. From that point on, all account management, billing, support, and service runs through Brinks Home directly.

Documents we'll send you

By giving us your email, you agree that we can send your agreement documents, billing statements, account notices, service updates, and other correspondence electronically to that address. This includes your executed Brinks Home agreement (if applicable), billing notices, and rate adjustment notices.

If you'd rather have something in paper form, just contact support@legacyalarm.com. Paper requests don't affect your obligations. You're responsible for keeping your email current.

Texts and calls

By giving us your phone number, you consent to receive calls and text messages from Legacy Alarm, Brinks Home, and our authorized partners at that number, including numbers on the National Do Not Call Registry. This applies whether you reached us through a lead form, an ad, a referral, or directly.

Messages may include account setup, scheduling, billing notifications, system alerts, and promotional offers. Calls and texts may use automated dialing or prerecorded voice. Consent to marketing isn't a condition of purchase. Standard message and data rates may apply.

To opt out of marketing texts, reply STOP. To opt out of marketing calls, email support@legacyalarm.com. Opting out of marketing doesn't affect transactional messages tied to your account. T-Mobile and other carriers aren't liable for delayed or undelivered messages.

Location data

The Alarm.com platform and our mobile app may collect location data from your phone and System to power features like geo-fencing, automatic arming when you leave, app-based control, and emergency dispatch confirmation. The Alarm.com and Brinks Home privacy policies also cover how this data is used. We don't sell your location data.

Your privacy

We collect personal information, including your name, address, date of birth, email, phone, payment details, and credit inquiry results, to verify eligibility, process your order, provide monitoring, and communicate with you. We share information with service partners necessary to fulfill your plan: Brinks Home, Alarm.com, and our payment processors. We don't sell your personal information.

California residents have rights under the California Consumer Privacy Act (CCPA), including access to, correction of, and deletion of personal data we hold. To exercise these rights, contact support@legacyalarm.com.

If there's ever a data breach

If a security incident affects your personal information, we'll notify you and the appropriate authorities as required by California Civil Code Section 1798.82 and other applicable law.

The soft credit check

By providing your date of birth and agreeing to these terms, you authorize us to obtain a soft credit inquiry through a third-party consumer reporting agency, in compliance with the Fair Credit Reporting Act. This verifies your identity and confirms eligibility for our promotional equipment offer.

This authorization is granted now. The inquiry itself occurs when you submit payment at checkout, and approval is a condition of completing your order. If the inquiry doesn't pass, your payment won't be processed and your order won't be completed.

A soft inquiry doesn't affect your credit score and doesn't show up as a hard inquiry on your credit report.

You also agree that we may report your account to consumer reporting agencies if it becomes delinquent.

Account security

If you create an account or use a customer portal, you're responsible for keeping your login credentials confidential. Let us know right away if you suspect unauthorized access. We may suspend or end account access without prior notice if we detect unauthorized activity, and we're allowed to act on instructions received through authenticated sessions as if they're from you.

Reviews, photos, and content you share

If you submit a review, testimonial, photo, video, or social media post to us, or publicly tag, mention, or reference Legacy Alarm or any affiliated brand on any platform, you give us a perpetual, royalty-free, worldwide license to use, reproduce, display, and adapt that content for marketing, advertising, or promotional purposes in any medium, without owing you anything for it. You confirm that anything you submit doesn't infringe the rights of anyone else.

Ideas you send our way

If you send us suggestions, feature ideas, or product feedback, those become ours to use however we'd like, with no confidentiality obligation and no compensation owed. We may use, disclose, or implement your suggestions for any purpose.

Keeping your system in good shape

You agree to test your System at least once a month to confirm it's working and signals are reaching the monitoring center. Let us know whenever you make changes to your internet, Wi-Fi, home phone service (VoIP or DSL), or anything else that could affect how your System communicates. Keep your contact information, emergency contact list, and payment method current with us and with Brinks Home.

Permits and false alarms

You're responsible for obtaining and maintaining any permits or registrations your city or county requires for alarm system use. If a missing or expired permit affects monitoring, that's not on us or Brinks Home. You're also responsible for any false alarm fines your local authorities issue, whether they're directed at you, us, or Brinks Home.

Things outside anyone's control

We're not liable for service interruptions caused by strikes, riots, floods, storms, earthquakes, fires, power failures, cellular or internet outages, supply chain issues, regulatory shutdowns, acts of God, or anything else beyond reasonable control. Your System depends on cellular and internet networks neither we nor Brinks Home control. Communication failures, signal interference, or transmission issues outside our control can prevent signals from reaching the monitoring center. In any such event, services may be suspended or delayed without liability or notice.

What we're responsible for, and what we're not

A few important things you should know:

LEGACY ALARM AND BRINKS HOME ARE NOT INSURERS. THE FEES YOU PAY US AREN'T INSURANCE PREMIUMS. WE DON'T WARRANT THAT YOUR SYSTEM OR MONITORING WILL PREVENT ANY LOSS BY BURGLARY, FIRE, ROBBERY, OR OTHERWISE, OR THAT THE SYSTEM WILL IN ALL CASES PROVIDE THE NOTIFICATION SERVICE FOR WHICH IT IS INTENDED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMBINED LIABILITY OF LEGACY ALARM AND BRINKS HOME FOR ANY LOSS, DAMAGE, OR INJURY ARISING FROM YOUR SYSTEM OR MONITORING SERVICES, REGARDLESS OF THE CLAIM, INCLUDING NEGLIGENCE, FAILURE TO PERFORM, OR VIOLATION OF ANY LAW, SHALL NOT EXCEED ONE THOUSAND DOLLARS ($1,000). THIS APPLIES TO BOTH THE 36 OR 60 MONTH PLAN AND MONTH-TO-MONTH CUSTOMERS.

Some states don't allow these kinds of limits, so the above applies to the maximum extent permitted by law where you live.

If you want greater protection, get homeowner's or renter's insurance. Unless your insurance policy or applicable law prohibits it, you release Legacy Alarm and Brinks Home from any subrogation claim brought by your insurance carrier and agree to share this provision with them.

No promise of crime prevention

Monitoring is provided by Brinks Home, an independent third party. Legacy Alarm is an authorized dealer, not the monitoring operator. We make no warranty about Brinks Home's response times, dispatch capability, or service continuity, and neither we nor Brinks Home guarantee crime prevention, loss prevention, personal safety, or emergency response time.

If someone else makes a claim involving you

To the fullest extent permitted by law, you agree to defend and hold harmless Legacy Alarm and Brinks Home, and our officers, directors, employees, agents, contractors, and representatives, from claims, losses, damages, and liabilities arising from these terms that are brought by anyone other than you. That includes family members, guests, landlords, tenants, and your insurance carrier, even if the claim alleges our negligence. This doesn't apply to willful misconduct, intentional acts, or gross negligence where the law prohibits it.

The one-year window

To the fullest extent permitted by law, no legal action of any kind relating to these terms or your System can be brought against Legacy Alarm or Brinks Home more than one year after the claimant has incurred an ascertainable loss arising from the act or event the action is based on.

How we handle disagreements

BINDING ARBITRATION. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LEGACY ALARM AND YOU AGREE TO RESOLVE ALL CLAIMS, DISPUTES, OR LAWSUITS ARISING OUT OF OR RELATED TO THESE TERMS, YOUR SYSTEM, OR ANY BUSINESS RELATIONSHIP BETWEEN US THROUGH BINDING ARBITRATION RATHER THAN IN COURT. THIS IS MANDATORY, NOT OPTIONAL. ARBITRATION IS CONDUCTED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS CONSUMER ARBITRATION RULES AND THE FEDERAL ARBITRATION ACT. IT TAKES PLACE IN THE STATE AND COUNTY WHERE THE PREMISES IS LOCATED, UNLESS WE BOTH AGREE OTHERWISE.

CLASS ACTION WAIVER. YOU AND LEGACY ALARM AGREE THAT EACH PARTY MAY ONLY BRING CLAIMS AGAINST THE OTHER INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

JURY TRIAL WAIVER. YOU AND LEGACY ALARM WAIVE THE RIGHT TO A JURY TRIAL OR BENCH TRIAL FOR ANY CLAIM SUBJECT TO ARBITRATION UNDER THESE TERMS.

PUNITIVE DAMAGES WAIVER. YOU AND LEGACY ALARM WAIVE ANY RIGHT TO CLAIM OR RECOVER PUNITIVE DAMAGES AGAINST THE OTHER.

Arbitration proceedings, including any decisions and awards, are confidential.

Your right to cancel

YOU, THE BUYER, MAY CANCEL THIS TRANSACTION AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THIS TRANSACTION WITHOUT ANY PENALTY OR OBLIGATION.

IF YOU ARE 65 YEARS OF AGE OR OLDER, YOU, THE BUYER, MAY CANCEL THIS TRANSACTION AT ANY TIME PRIOR TO MIDNIGHT OF THE FIFTH BUSINESS DAY AFTER THE DATE OF THIS TRANSACTION WITHOUT ANY PENALTY OR OBLIGATION.

To cancel, send a signed, dated written notice by email to support@legacyalarm.com or by mail to Legacy Alarm, PO Box 82, Rocklin, CA 95677. When we receive valid cancellation within the applicable window, we'll refund any payments within 10 business days and cancel the Brinks Home agreement on your behalf.

If equipment has already shipped when you cancel, you need to make it available for return in substantially the same condition you received it in. We'll arrange pickup or send you a prepaid return label at our expense. If you don't make the equipment available and we don't retrieve it within 20 days of your cancellation notice, you may keep or dispose of the equipment without further obligation.

Compliance with the law

You agree to use your System in compliance with all applicable laws. We're not responsible for any unlawful activity on your part, and if such activity creates legal exposure for us, you agree to indemnify and defend us, including paying attorney fees and court costs. We may be required by law to disclose communications or records to government agencies or law enforcement pursuant to valid legal process, and we're not responsible for costs or changes required by regulatory updates after the date of these terms.

Can this be transferred

You can't assign these terms or any rights or obligations under them without our written consent, except for the home sale transfers described earlier. We can assign or subcontract our obligations under these terms, including to Brinks Home or any successor entity, without notifying you. Any assignee receives all rights and protections we have under these terms.

Electronic signatures and records

You agree that electronic signatures, contracts, and records have the same legal effect as paper ones. You consent to electronic records throughout your relationship with us.

Changes to these terms

We may update these terms over time. Material changes get communicated to your email at least 30 days before they take effect. Continuing to use our services after the effective date means you've accepted the updated terms.

If part of these terms isn't enforceable

If any provision is found invalid or unenforceable, it's amended to the minimum extent necessary to be enforceable, and the rest of the terms stay in full effect.

No waiver

If we don't enforce a provision right away, that doesn't mean we've waived our right to enforce it later.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Subject to the arbitration provisions above, any court action permitted under these terms takes place in the state or federal courts located in California.
